This website exists to tell you about Classical Not Classical™ and to let orchestras, presenters, venues, and press get in touch. You are welcome to browse it, share links to it, and quote it fairly. The name, the artwork, the arrangements, the photographs, and the video are protected, so please ask before reusing them. Nothing on the site is a contract offer. If we ever do business together, that will be on paper.
1. Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of classicalnotclassical.com, news.classicalnotclassical.com, and any other page or subdomain we operate that links to these Terms (together, the “Site”). The Site is operated by Classical Not Classical™, a concert production created and owned by Michael Rainwater and based in the State of Georgia, United States (“we,” “us,” or “our”).
By accessing or using the Site you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site. If you are using the Site on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
2. What the Site is, and is not
The Site is an informational and promotional website for a live symphonic concert production. It describes the production, its creator, and how to inquire about presenting it. It provides a booking-inquiry form and management contact details.
- The Site does not sell tickets, merchandise, sheet music, or recordings, and does not process payments.
- The Site does not create user accounts or require registration.
- Nothing on the Site is an offer capable of acceptance. Descriptions of the production, repertoire, ensemble sizes, dates, venues, availability, and pricing (where mentioned) are informational, may change without notice, and become binding only through a separate written engagement agreement signed by authorized representatives.
- Premiere timing described on the Site (for example, “Fall 2026”) is a plan, not a guarantee. Dates and venues are announced when confirmed.
3. Trademarks and copyright
Trademarks
CLASSICAL NOT CLASSICAL™, the strike-through wordmark, the piano-and-pianist sketch, the tagline “Where the piano becomes the pop star,” and related logos and trade dress are trademarks of Michael Rainwater (the “Marks”). The ™ symbol indicates a claim of trademark rights under U.S. common law and applicable state law; where a federal registration is obtained the ® symbol will be used. You may not use the Marks, or any confusingly similar name, mark, or domain name, in connection with any product, service, event, or website without our prior written permission. Truthful, non-misleading references to the production by name (for example, in a review, a news story, or a presenter’s season listing under an executed agreement) are permitted.
Other names and marks that appear on the Site, including the names of recording artists and songwriters whose works are arranged in the production, and the names of venues, publications, and platforms, belong to their respective owners and are used for identification only. No affiliation or endorsement is implied.
Copyright
Unless otherwise noted, all content on the Site, including text, biographies, the white paper and any excerpts from it, photographs, illustrations, the hero sketch animation, video, audio, page design, and the selection and arrangement of the Site, is owned by or licensed to Michael Rainwater and is protected by United States and international copyright laws. © 2026 Classical Not Classical™. The orchestral arrangements performed in Classical Not Classical are original works created by Michael Rainwater and, where applicable, the production’s musical director. They are separately protected. The underlying songs remain the property of their respective songwriters and publishers and are performed under the licenses that apply to live performance and recorded media.
4. What you may do
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Site and view its content for your personal, non-commercial use, or for the internal business purpose of evaluating the production for presentation, coverage, or sponsorship. You may:
- link to any page of the Site, provided the link does not misrepresent us or imply endorsement;
- share our public social-media posts and embedded videos using the sharing tools those platforms provide;
- quote brief excerpts of text from the Site for news reporting, criticism, commentary, or scholarship, with attribution, in a manner consistent with fair use;
- print or save single copies of pages for your own reference.
Accredited press may use the biography text and the photographs identified on the Press page for editorial coverage of the production, with the photo credit provided. Any other use of press assets, including advertising, merchandise, or use in connection with a different event, requires written permission.
5. What you may not do
Except as expressly permitted above, you agree not to:
- copy, reproduce, download, republish, redistribute, publicly display, or create derivative works from any photograph, illustration, video, audio, or arrangement on the Site, including by re-uploading our videos to any platform or extracting audio from them;
- use the Site’s photographs, video, or Marks to advertise, promote, or imply an association with any concert, act, or product other than the production presented under an agreement with us;
- transcribe, notate, or otherwise reproduce the arrangements, in whole or in part, from any recording or video on the Site;
- frame or mirror any part of the Site, remove or alter any copyright, trademark, or other proprietary notice, or use meta tags or hidden text using our name or Marks;
- use automated means to harvest media, form data, or contact details from the Site, or to submit inquiries through the booking form. (Ordinary search-engine and AI-assistant crawling for indexing and discovery is permitted as described in our robots.txt file; bulk copying of media is not.)
- submit false, misleading, defamatory, infringing, or unlawful content through the booking form, impersonate any person or organization, or use the form to send unsolicited commercial messages;
- interfere with the operation or security of the Site, probe or test its vulnerabilities, or attempt to access any part of it that is not intentionally made public;
- use the Site in any way that violates applicable law.
We may suspend or block access to the Site, and may remove or refuse any submission, at our discretion and without notice.
6. Booking inquiries and other submissions
When you send us a booking inquiry, a press request, or any other message through the Site or by email, you represent that the information you provide is accurate, that you are entitled to provide it, and that you are at least 18 years old or acting under the supervision of an adult who is. We use what you send us to respond to you and as described in our Privacy Policy.
Please do not send us unsolicited creative material, such as arrangements, scores, recordings, scripts, or concept proposals. If you do, you agree that we are under no obligation of confidentiality with respect to it, that we may already be developing similar material, and that you will not assert any claim against us based on any alleged similarity between your submission and our work.
Any ideas, suggestions, or feedback you voluntarily send us about the Site or the production may be used by us without restriction or compensation.
7. Third-party content, links, and services
The Site embeds video from YouTube and links to third-party websites and platforms, including Instagram, TikTok, X, Spotify, Apple Music, SoundCloud, our newsroom, publications that have covered the production, and michaelrainwatermusic.com. Those sites and services are governed by their own terms and privacy policies, which we encourage you to read. We do not control them and are not responsible for their content, availability, accuracy, or practices. A link does not imply that we endorse the linked site or that it endorses us.
Embedded YouTube players are subject to the YouTube Terms of Service.
8. Accuracy of information
We try to keep the Site accurate and current, but it may contain typographical errors, outdated information, or omissions. Biographical details, credits, statistics (for example, view counts or funds raised through charitable concerts), repertoire lists, and descriptions of the production are provided in good faith as of the date they were written and may change. We may correct or update any content at any time without notice and are not obligated to do so.
9. Disclaimer of warranties
THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER CLASSICAL NOT CLASSICAL, MICHAEL RAINWATER, NOR ANY OF OUR MANAGEMENT, COLLABORATORS, CONTRACTORS, OR SERVICE PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where such limitation is prohibited.
These Terms apply to the Site only. Any liability arising from a live performance or an engagement agreement is governed by that agreement, not by these Terms.
11. Indemnification
You agree to defend, indemnify, and hold harmless Classical Not Classical, Michael Rainwater, and our management, collaborators, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or connected with your violation of these Terms, your misuse of the Site or its content, or any content you submit.
12. Copyright and trademark complaints
We respect the intellectual property of others. If you believe that content on the Site infringes a copyright or trademark you own or control, please send a notice to our management at rickkanfer@me.com with the subject line “IP notice” that includes: (a) identification of the work you claim is infringed; (b) identification of the material on the Site you claim is infringing, with its URL; (c) your name, mailing address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. We will review and respond promptly.
If you believe your own content was removed by mistake, you may send us a counter-notice with the information required by 17 U.S.C. § 512(g)(3).
13. Privacy
Our Privacy Policy explains what information the Site collects, how we use it, who we share it with, and the choices and rights you have. It forms part of these Terms.
14. Accessibility
We want everyone to be able to use the Site. Our Accessibility Statement describes the standard we work to, what we have done, known limitations, and how to reach us if something is not working for you.
15. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Georgia and the federal laws of the United States, without regard to conflict-of-laws principles. You agree that the state and federal courts located in the State of Georgia have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue in those courts. Before filing any claim, you agree to contact us at the address below and to make a good-faith effort to resolve the matter informally for at least thirty (30) days.
The Site is controlled from the United States. We make no representation that the Site or its content is appropriate or available in other locations. If you access the Site from outside the United States you do so on your own initiative and are responsible for compliance with local laws.
16. General provisions
- Changes. We may revise these Terms at any time by posting an updated version on this page with a new effective date. Material changes will be indicated by the date at the top of this page. Your continued use of the Site after a change means you accept the revised Terms.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Site and supersede any prior understandings about it. They do not modify any separate written agreement between you and us about a performance.
- Severability. If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them to any successor to the production.
- Survival. Sections 3, 5, 6, and 9 through 16 survive any termination of your access to the Site.
